NZTR lays serious charges against two jockeys for serious racing offencesNZTR

New Zealand Thoroughbred Racing (NZTR) on Wednesday filed charges against Jockeys Opie Bosson and Bruce Herd following random drug testing of Riders at Te Rapa Racecourse on Friday, the 3rd of October 2008.
Mr Herd is charged under Rule 1001 (1) (p), a Serious Racing Offence, and under Rule 528 (2), Drug Testing of Riders.
Further Mr Bosson is charged under Rule 1001 (1) (p), a Serious Racing Offence, and under Rule 528 (2), Drug Testing of Riders, for aiding and abetting Jockey Herd in both offences.
The relevant Rules of Racing are as follows:
1001 (1) Every person commits a serious racing offence within the meaning of these Rules who, in New Zealand or any other country:
(p) commits any dishonest or fraudulent act connected with racing or the on-course or off-course Totalisator
528 (2) Every rider or stablehand who, having been required by a Stipendiary Steward or Racecourse Inspector or Judicial Committee to supply a sample of his blood, breath, urine, saliva or sweat (or more than one thereof), at a time and place nominated by the Stipendiary Steward or Racecourse Inspector or Judicial Committee who refuses or fails to comply with such a request commits a breach of this Rule. Any breach of this Rule shall be reported to the Board of Thoroughbred Racing by the Registrar of the Judicial Committee which dealt with the breach and that Board shall consider whether, in addition to any penalty imposed by the Judicial Committee the Licence or Certificate of a rider shall be cancelled or withdrawn under Rule 318(1) of these Rules.
